Welcome to LeapNest. By accessing or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using LeapNest, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our app.

2. Description of Service

LeapNest is a financial tracking and planning application designed to help users save for and purchase their dream home. Our services include:

• Tracking income and expenses
• Managing multiple properties (current, in-progress, and prospects)
• Calculating home buying readiness and financial forecasts
• Providing savings goals and progress tracking
• Moving properties through workflow stages (prospect → in-progress → active)
• Sending notifications about financial milestones
• Offering personalized recommendations

3. User Accounts

Account Creation

You must create an account to use LeapNest. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Account Eligibility

You must be at least 18 years old to use LeapNest. By using our app, you represent that you meet this requirement.

Apple Sign-In

LeapNest offers the option to create an account or sign in using Apple Sign-In. When you choose to use Apple Sign-In:

• You are subject to Apple's Terms and Conditions and Privacy Policy in addition to these Terms of Service
• Apple may provide us with your name and email address as associated with your Apple ID, subject to your privacy settings
• You can revoke our access to your Apple ID at any time through your Apple account settings
• If you revoke Apple Sign-In access, you may need to create a new account using email and password to continue using LeapNest

By using Apple Sign-In, you acknowledge and agree that Apple is not responsible for LeapNest's services or content, and that your use of Apple Sign-In is governed by Apple's terms and conditions.

4. User Responsibilities

You agree to:

• Use the app only for lawful purposes
• Not attempt to gain unauthorized access to our systems or networks
• Not interfere with or disrupt the app's functionality
• Not use the app to transmit harmful code or malware
• Not misrepresent your identity or impersonate others

5. Financial Information Disclaimer and User Responsibility

User-Supplied Information: All financial information, data, and content entered into LeapNest is supplied solely by you, the user. LeapNest does not independently verify, validate, or authenticate any financial information you provide, including but not limited to income amounts, expense categories, property values, savings goals, or any other financial data.

Not Financial Advice: LeapNest is a financial tracking and planning tool designed to help you organize and visualize your financial information. LeapNest is NOT a financial advisor, investment advisor, mortgage broker, real estate agent, or any other type of licensed financial professional. We do not provide financial, investment, tax, legal, or any other professional advice.

Informational Purposes Only: All calculations, forecasts, projections, recommendations, and other outputs generated by LeapNest are provided for informational and educational purposes only. These outputs are estimates based on the information you provide and should not be construed as financial, investment, or legal advice. LeapNest makes no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any calculations, forecasts, or recommendations for your specific financial situation.

Sole Risk and Responsibility: YOUR USE OF LEAPNEST FOR ANY FINANCIAL DECISIONS, INCLUDING BUT NOT LIMITED TO HOME PURCHASE DECISIONS, SAVINGS PLANNING, BUDGETING DECISIONS, OR ANY OTHER FINANCIAL MATTERS, IS AT YOUR SOLE RISK. LeapNest, its affiliates, officers, directors, employees, agents, and licensors (collectively, "LeapNest Parties") shall not be liable for any financial decisions you make, or fail to make, based on information, calculations, forecasts, or recommendations provided by or through the LeapNest application.

Consultation with Professionals: You acknowledge and agree that before making any significant financial decisions, including but not limited to purchasing a home, making investment decisions, or entering into financial agreements, you should consult with qualified, licensed professionals, including but not limited to certified financial planners, licensed financial advisors, certified public accountants, tax advisors, real estate attorneys, mortgage brokers, or other appropriate professionals who can provide advice tailored to your specific circumstances.

No Guarantees: LeapNest makes no guarantees, representations, or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or suitability of any calculations, forecasts, projections, recommendations, property valuations, market data, or financial information displayed, or your ability to achieve any savings goals or financial objectives.

6. Intellectual Property

LeapNest and its content (including text, graphics, logos, and software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content
• Reverse engineer or decompile our software
• Remove copyright or proprietary notices
• Use our trademarks without permission

7. User Data

You retain ownership of the data you input into LeapNest. By using our app, you grant us a license to use your data to provide and improve our services, as described in our Privacy Policy.

You can:

• Export your data at any time
• Request deletion of your data
• Control how your data is used through app settings

8. Subscriptions and Billing

Subscription Tiers

LeapNest offers three subscription tiers:

• Free Tier: Access to up to 2 properties (oldest active and oldest prospect property). Basic financial tracking features.
• Premium Tier: Access to up to 5 properties. Includes all Free tier features plus the ability to move properties through the workflow (prospect → in-progress → active) and advanced financial tracking.
• Ultimate Tier: Unlimited properties. Includes all Premium tier features plus priority support.

Billing and Payment

Premium and Ultimate subscriptions are billed monthly or annually. Each subscription period is clearly identified:

• Premium Monthly: $9.99 per month (1-month subscription period)
• Premium Annual: $99.99 per year (12-month subscription period, save 17% compared to monthly)
• Ultimate Monthly: $19.99 per month (1-month subscription period)
• Ultimate Annual: $199.99 per year (12-month subscription period, save 17% compared to monthly)

By subscribing, you agree to:

• Pay the full subscription fee at the time of purchase
• Payment processing through Apple In-App Purchase (iOS) or other platform payment providers
• Price changes will be communicated in advance and will not affect your current subscription period

Auto-Renewal and Subscription Management

Automatic Renewal: Your subscription will automatically renew at the end of each subscription period (monthly or annual) unless you cancel it at least 24 hours before the end of the current period. You will be charged the full subscription price to your Apple ID account or other payment method on file.

How to Manage Your Subscription (iOS): To cancel, manage, or change your subscription, you must do so through your Apple account settings. Please follow these steps:

1. Open Settings on your iPhone or iPad
2. Tap on your name (Apple ID) at the top
3. Tap "Subscriptions"
4. Find and select "LeapNest" from the list
5. You can then cancel, change your plan, or view subscription details

Important: You can cancel your subscription at any time. If you cancel, you will continue to have access to Premium or Ultimate features until the end of your current paid subscription period. After the period ends, your subscription will not renew and you will lose access to Premium or Ultimate features, but you will retain access to all your data and Free tier features.

Subscription Period: Your subscription period begins immediately upon purchase and renews automatically at the end of each period unless cancelled. Monthly subscriptions renew every month. Annual subscriptions renew every 12 months.

Cancellation and Refunds

How to Cancel (iOS): For subscriptions purchased through the Apple App Store, you must cancel through your Apple account settings as described in the "Auto-Renewal and Subscription Management" section above. Cancellations cannot be processed through the LeapNest app settings for iOS subscriptions.

When Cancellation Takes Effect: When you cancel your subscription, the cancellation will take effect at the end of your current subscription period. You will continue to have full access to all Premium or Ultimate features until the end of the paid period. Your subscription will not renew automatically after the current period ends.

24-Hour Notice: To prevent automatic renewal for the next billing period, you must cancel your subscription at least 24 hours before the end of your current subscription period. If you cancel within 24 hours of the renewal date, you may still be charged for the next period, but your subscription will not renew after that period.

Refunds: Refunds for subscriptions are handled according to the policies of the platform through which you subscribed. For Apple App Store purchases, refunds are managed through Apple's refund policy and process. We do not provide direct refunds for subscriptions purchased through app stores. If you have questions about refunds, please contact Apple Support (for iOS subscriptions) or the appropriate platform support.

Subscription Changes

You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately. Downgrades take effect at the end of your current billing period. If you downgrade from Premium or Ultimate to Free, you will retain access to all your data but may be limited to Free tier features (2 properties visible).

9. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The app will be available 100% of the time
• The app will be error-free or uninterrupted
• Defects will be corrected immediately

We reserve the right to modify, suspend, or discontinue the app at any time without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEAPNEST, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS (COLLECTIVELY, "LEAPNEST PARTIES") SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF SAVINGS, FINANCIAL LOSSES, LOSS OF DATA, LOSS OF OPPORTUNITY, OR ANY OTHER HARM ARISING FROM OR RELATED TO YOUR USE OF LEAPNEST, INCLUDING BUT NOT LIMITED TO FINANCIAL DECISIONS MADE BASED ON APP INFORMATION, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF LEAPNEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim will not exceed the amount you paid us in the past 12 months for your subscription (or $0 if you are on the Free tier).

11. Indemnification

You agree to indemnify, defend, and hold harmless the LeapNest Parties from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the app, including any financial decisions made based on app information
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may terminate or suspend your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Abuse or misuse the app

You may terminate your account at any time by deleting your data through the app settings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the app and updating the "Last Updated" date. Your continued use of the app after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved in the appropriate courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
